TheParkatNJ LLC, and its affiliates and subsidiary companies,
including without limitation Connell Cycling LLC (collectively, "Company" or "We," "Us," "Our," etc.)
respect your privacy and are committed to protecting it through our compliance
with this policy. This policy describes:

that you may provide when you download, install, create an account on, access,
or use, or enjoy the services (including the bicycle share program) facilitated
by, the Park Bike mobile application (the "App").
· Our practices for collecting, using,
maintaining, protecting, and/or disclosing that information.
This policy applies only to information we collect in
this App and in email, text, and other electronic communications sent through or
in connection with this App.
This policy DOES NOT apply to information that:
· We collect offline (including “in person”)
or on any other Company apps or websites, including websites you may access
through this App.
· You provide to or is collected by any third
party, including other apps, websites, or content that may link to or be
accessible from or through this App (see Third Party Information Collection,
below).
Our websites and apps, and these other third parties
may have their own privacy policies, which we encourage you to read before
providing information on or through them.
Please read this policy carefully to understand our
policies and practices regarding your information and how we will treat it. If
you do not agree with our policies and practices, do not download, create an
account, or use this App. By downloading, creating an account, or using this
App, you agree to this privacy policy. This policy may change from time to time
(see Changes to Our Privacy Policy, below). Your continued use of this
App after we revise this policy means you accept those changes, so please check
the policy periodically for updates.
Persons Under the Age of 18 The App is not intended for persons under 18 years of
age. No one may provide any information, including any personal information,
from or relating to persons under the age of 18. We do not knowingly collect
personal information from children or any persons under the age of 18. If you
are under 18, do not use or provide any information on this App or through any
of its features, create an account on the App, use any interactive or public
comment features offered by or through the App, or provide any information
about yourself to us, including your name, address, telephone number, email
address, or any screen name or user name you may use. If you believe we might have any information
from or about a child or person under 18, please contact us. Information We Collect and How We Collect
It We collect information from and about users of our
App: · Directly from you when you provide it to
us. · Automatically when you use the App. · From third-parties. When you download, create an account, or use this App,
we may ask you provide information: · By which you may be personally identified, including
without limitation your name, postal address, email address, telephone number, and/or
any other identifier by which you may be contacted online or offline ("personal information"). · That is otherwise about you but individually does not, on its own, identify you personally, including without limitation information about your usage of the App, the bicycle rental program at The Park, Berkeley Heights, New Jersey, or the associated products,amenities or other offerings delivered through, or in connection with, the App. This information includes: · Any information that you provide by filling
in forms or questionnaires in the App. This further includes information
provided at the time of downloading and/or creating an account on the App, subscribing
(if/as applicable) to our service, posting any material, and/or requesting
further services. We may also ask you for information when you enter a contest
or promotion sponsored by us, respond to any survey or questionnaire delivered
through or in connection with the App, and when you report a problem with the
App. · Information collected from you related to account/App
registration, management, profile creation, modification and alteration, your
use of the App and the bicycle rental program at The Park, Berkeley Heights, New Jersey facilitated thereby, and the uploading of content on the App. · Where applicable, your birthday and
driver’s license information or other forms of acceptable identification. · Records and copies of your correspondence
(including email addresses and phone numbers), if you contact us, including any
communications in connection with seeking or providing technical support and
other customer service. · Your responses to surveys that we might ask
you to complete for research purposes. · Details of transactions you carry out
through the App and of the fulfillment of your orders. You may be required to
provide financial information before making any reservation or placing an order
through the App, in which case information collected will include credit card
numbers, billing details and billing address, communications preferences, and
transaction history some or all of which may be provided through a third party payment processing company or similar service
provider, in which event the terms, conditions, and privacy policies of such
provider will be applicable. · Your search queries on the App. You may also provide information for publication or
display ("Posted") on
public areas of the App or websites you access through the App (collectively,
"User Contributions").
Your User Contributions are Posted and transmitted to others at your own risk. We
cannot control the actions of third parties with whom you may choose to share
your User Contributions. Therefore, we cannot and do not guarantee that your
User Contributions will not be viewed by unauthorized persons. Information
We Collect Through Automatic Data Collection Technologies As you navigate through and interact with our App,
including when you download, access, or use the App (including use of the App in
connection with enjoyment of the bicycle rental program at The Park, Berkeley
Heights, New Jersey), we may use automatic data collection technologies to
collect certain information about your device and your
browsing and usage activity and patterns, including: · Usage
Details. When you access
and use the App, we may automatically collect certain details of your access to
and use of the App, including traffic data, location data, logs, and other
communication data and the resources that you access and use on or through the
App. · Device
Information. We collect
information about your computer, browser, smart phone / mobile device or other
device (each, a “device”) that you use to access the App. We may use
cookies, pixels, log files and other similar technologies to collect such
information, including IP address, mobile network information, device
identifiers and other unique identifiers, browser type, browser language,
operating system name, and version, device name and model, version, referring
and exit pages, dates and times you access the App or use the bicycle share
program in connection therewith, the length of time that you are logged into or
using the App or services enabled thereby, the links you click or features you
use, software crash reports and session identification number. · Stored
Information and Files. The
App also may access metadata and other information associated with other files
stored on your device. This may include, for example, photographs, audio and
video clips, personal contacts, and address book information. · Location
Information and Vehicle Usage. We automatically collect and store location information from your device
and from any bicycles or other vehicles belonging to us that you use in
connection with the bicycle rental program at The Park, Berkeley Heights, New
Jersey that is facilitated by the App (“Vehicles”). We collect and store
the location information (e.g., city, state or zip code where available)
associated with the IP address of the device you use to access the App and
receive services from us in connection therewith, as well as, with your
permission, your mobile device’s location information. Please note that while you
may be able to change your location settings for your mobile device, if you
choose to do so, certain features may not be available through the App. We also
collect precise GPS location information regarding the location of our Vehicles
used by or made available to you in connection with the bicycle rental program at
The Park, Berkeley Heights, New Jersey, the routes taken by such Vehicles, and the
status of the Vehicles, including the rental, performance and GPS status of
such Vehicles. We also automatically collect data regarding the date, time and
length of the Vehicle usage. · Camera and Photographic Data. We may collect photographic data through the App, as hereafter described, in connection with your use of our services. This may include: (i) pre- and/or post-ride photographs that riders are (or may be) required to take and submit in connection with their use of the bicycle rental program at The Park, Berkeley Heights, New Jersey, such as photographs required prior to, or after conclusion of Vehicle usage (ii) photos or other similar or related device data sent during interactions with our customer support team or in order to report an incident. Such photos are, or may be, used to verify Vehicle status or condition, ride conclusion, rider safety and proper Vehicle usage, as well as to facilitate and assist in resolving customer support queries. In addition, use of the services facilitated by the App may require you to permit access certain functions of your device which in some cases (depending on a device and its operating system or other features) may require you to grant certain permissions on a case-by-case basis. Access to your device’s camera feature may be required to scan QR codes used in connection with the App and the services it enables, including such as check points, stations, and Vehicle parking areas, or other signage or postings related to the bicycle rental program at The Park, Berkeley Heights, New Jersey. The camera may also be necessary to verify driving license, user identity, or other similar matters relating to usage of Vehicles and participation in the bicycle rental program at The Park, Berkeley Heights, New Jersey. You may also be afforded the opportunity to upload or provide, at your discretion, photos to a user profile or otherwise within the App. · Analytics. We compile and analyze information derived from the use of our services, including, but not limited to, aggregate usage patterns, user preferences, peak demand times and common routes. If you do not want us to collect this information do
not download the App or delete it from your device. However, please note that opting out of the
App's collection of location information will disable its location-based
features. The technologies we use for automatic information
collection may include: · Cookies
(or mobile cookies). A
cookie is a small file placed on your smartphone. It may be possible to refuse
to accept mobile cookies by activating the appropriate setting on your
smartphone. However, if you select this setting you
may be unable to access certain parts of our App. · Web
Beacons. Pages of the App
and our emails may contain small electronic files known as web beacons (also
referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the
Company, for example, to count users who have visited those pages or opened an
email and for other related app statistics (for example, recording the
popularity of certain app content and verifying system and server integrity). Except as expressly noted in this policy, we do not
collect personal information automatically, but we may tie non-personal
information collected automatically to personal information about you that we
collect from other sources or that you provide to us. Third-Party
Information Collection When you use the App or its content, certain third
parties may use automatic information collection technologies to collect
information about you or your device. These third parties may include: · Advertisers, ad networks, and ad servers. · Analytics companies. · Your mobile device manufacturer. · Your mobile service provider. · Credit card and payment processing service
providers. These third parties may use tracking technologies to
collect information about you when you use this app. The information they
collect may be associated with your personal information or they may collect
information, including personal information, about your online activities over
time and across different websites, apps, and other online services websites.
They may use this information to provide you with interest-based (behavioral)
advertising or other targeted content. We do not control these third parties' tracking
technologies or how they may be used. If you have any questions about an
advertisement or other targeted content, you should contact the responsible
provider directly. We and our authorized third-party service providers
may use information that we collect about you or that you provide to us,
including any personal information, to: · Provide you with the App and its contents,
and any other information, products, or services that you request from us. · Provide you with access to the bicycle
rental program at The Park, Berkeley Heights, New Jersey and use of the
Vehicles in connection therewith, all in accordance with the terms and
conditions for the use of such program. · Fulfill any other purpose for which you
provide it. · Give you notices about your account, your
use of the bicycle rental program at The Park, Berkeley Heights, New Jersey,
and your use of the Vehicles in connection therewith. · Carry out our obligations and enforce our
rights arising from any contracts entered into between you and us, including
for billing and collection. · Notify you when App updates are available,
and of changes to any products or services we offer or provide though it. The usage information we collect helps us to improve
our App and to deliver a better and more personalized experience by enabling us
to: · Estimate our audience size and usage
patterns. · Store information about your preferences,
allowing us to customize our App according to your individual interests. · Speed up your searches. · Recognize you when you use the App. We use location information we collect to track the
location and usage of the Vehicles, and your use of the bicycle rental program at
The Park, Berkeley Heights, New Jersey, and to ensure and improve the
functionality of our App. We may also use your information to contact you about
our own and third parties' goods and services that may be of interest to you.
If you do not want us to use your information in this way, please adjust your
user preferences in your account profile. We may use the information we collect to display
advertisements to our advertisers' target audiences. Even though we do not
disclose your personal information for these purposes without your consent, if
you click on or otherwise interact with an advertisement, the advertiser may
assume that you meet its target criteria. Disclosure of Your Information We may disclose aggregated information about our
users, and information that does not identify any individual or device, without
restriction. In addition, we and our authorized third-party service
providers may disclose personal information that we collect or you provide: · To our subsidiaries and affiliates. · To contractors, service providers, and
other third parties we use to support our business. · To a buyer or other successor in the event
of a merger, divestiture, restructuring, reorganization, dissolution, or other
sale or transfer of some or all of our assets, whether as a going concern or as
part of bankruptcy, liquidation, or similar proceeding, in which personal
information held by us about our App users is among the assets transferred. · To third parties to market their products
or services to you if you have not opted out of these disclosures. · To fulfill the purpose for which you
provide it. · For any other purpose disclosed by us when
you provide the information. · With your consent. We may also disclose your personal information: · To comply with any court order, law, or
legal process, including to respond to any government or regulatory request. · To enforce our rights arising from any
contracts entered into between you and us, including the [Park Bike Mobile
Application End User Agreement] (available at: www.theparkatnj.com/park-bike-terms-and-conditions) and/or the [Rider’s General Terms and Conditions of Use, Release of Liability & Assumption of Risk, Indemnity
and Hold Harmless] (available at: www.theparkatnj.com/park-bike-rider-agreement), and for billing and collection. · If we believe disclosure is necessary or
appropriate to protect the rights, property, or safety of the Company, our
customers, or others. This includes exchanging information with other companies
and organizations for the purposes of fraud protection and credit risk
reduction.
Option To Discontinue Marketing-Related Communications
If you no longer want to receive marketing-related
emails, direct mail and other content from us on a going-forward basis, you may
opt-out by following the unsubscribe instructions in any such message or by
contacting us by email at privacy@connellco.com. We will undertake efforts to comply
with Your request as soon as reasonably practicable. Please note that if you
choose to discontinue receiving marketing-related emails from us, we may still
send you important administrative messages, which you cannot elect to
discontinue
We do not control third parties' collection or use of
your information to serve interest-based advertising. However, these third
parties may provide you with ways to choose not to have your information
collected or used in this way. You can opt out of receiving targeted ads from
members of the Network Advertising Initiative ("NAI") on the NAI's website.
Accessing and Correcting Your Personal
Information
You may have the right to access, request correction
and deletion of, and object to our use of, your information. To exercise such
rights, please contact us as set forth in the “Contact Information” section,
below. You may also access and modify most of the information that you have
submitted by logging into your account and updating your profile in the App.
Please note that prior versions of information that you have updated, modified
or deleted may remain viewable in cached and/or archived pages for a period of
time. In addition, we may retain certain
information about you as required by law, or as permitted by law for legitimate
business purposes (e.g., if you request that we delete your information but we
believe that you have violated our Terms of Service, we may retain such
information in order to attempt to resolve such issue before deleting it).
We take technical, physical, and organizational
measures to protect your personal information from accidental loss and from
unauthorized access, use, alteration, and disclosure. However, the safety and
security of your information thus also depends on you. Where we have given you
(or where you have chosen) a password for access to certain parts of our App,
you are responsible for keeping this password confidential. We ask you not to
share your password with anyone. Unfortunately, the transmission of information
via the internet and mobile platforms is not completely secure. Although we strive
to use commercially reasonable and acceptable means to protect your personal
information, we cannot guarantee the security of your personal information
transmitted through our App. Any transmission of personal information is at
your own risk. We are not responsible for circumvention of any privacy settings
or security measures included in or through the App.
We may update our privacy policy from time to time. The
date the privacy policy was last revised is identified at the top of the page. If
we make material changes to how we treat our users' personal information, you will be provided with appropriate
notice in accordance with legal requirements. You are responsible for ensuring we have an
up-to-date active and deliverable email address and/or phone number for you and
